Terms
This agreement
These terms apply to your use of Daily Loaf, the stamp card and campaigns software run by the Bakebound team, trading under an Australian sole-trader ABN, provided on request. Opening a Daily Loaf account means you accept them.
What the service is
Daily Loaf gives a bakery a stamp card that customers join with a mobile number confirmed by a texted code, a Members page for recording stamps and seeing reward codes, and, on Crumb and Hearth, campaigns by email, with texts on Hearth from a number provided for the bakery. This site describes everything the service does, and nothing beyond that is promised.
Plans and payment
There are three plans: Free, which is given in return for a marketing consent, Crumb at $23 a month and Hearth at $64 a month, all in Australian dollars. GST is not added, since the operator is not registered for it. Crumb and Hearth are billed monthly in advance by card through Stripe and can be cancelled at any time from Billing; cancelling stops the next charge, and the plan runs to the end of the period already covered. We will give at least thirty days notice by email to your confirmed address before any price changes.
What that consent covers, and how to withdraw it, is on the consent page. If you withdraw that consent while on Free, the plan runs to the end of the current month, Melbourne time, and then ends unless you choose Crumb or Hearth or give the consent again from the Account page.
Each plan's quotas (members, and campaign messages a month) are shown on the pricing page and in the dashboard. A monthly quota resets on the first day of each calendar month, Melbourne time.
What you are responsible for
You are responsible for what every campaign says, for honouring the reward you set, for following the Spam Act 2003, the Australian Consumer Law and any other rules that apply to your bakery, and for keeping your sign-in details safe. You must not use Daily Loaf to message anyone who did not join your club, and the service gives you no way to.
Your members
Everyone in your club is your customer, not ours. Their details are kept solely to run Daily Loaf for your bakery. You must act on a member's request to be removed and must not try to reach an opted-out member through the service.
Suspending or ending an account
We may suspend an account that breaks these terms or the acceptable use policy, after telling you why, unless the breach is serious. You can end your account at any time by cancelling and writing to hello@bakebound.com.au. When an account ends, its data is deleted as the privacy page describes.
The directory
Daily Loaf is separate from the Bakebound directory. Nothing in these terms, and no plan you choose, affects any listing, ranking or badge on Bakebound.
Liability
We run the service with reasonable care and skill. To the extent the law permits, we accept no liability for indirect or consequential loss, and for any claim our liability is capped at the fees you paid in the three months before it. Nothing in these terms limits a right you have under the Australian Consumer Law.
Governing law
Victorian law governs these terms, and any dispute goes to the courts of Victoria.
